Lawyer Hussein Naso, an administrator in the Kurdish Legal Authority, said in a statement to “Afrinpost” about his general evaluation of the report of the United Nations investigation committee on Syria, which was issued on September 14, 2020, that “the report in general is good, it is distinguished from other previous reports in that it indicates very clearly the responsibility of the Turkish state for many of the crimes that have been described as war crimes.
Concerning the expected importance of the report, and saying that it did not come out of the initial description circle, in order to settle its conclusions, Lawyer Hussein Naso said: “In our evaluation of the committee’s report, we have to distinguish between the indictment issued by a judicial body and the summary of what was reached by a committee charged with investigating a case, many of those who criticized the committee’s report did not realize that this report is not an indictment or a judgment issued by a judicial body until we discuss the elements of the crime, the circumstances of its occurrence, and confirm accusing anyone.
In a preliminary evaluation of the UN report, lawyer Hussein Naso said: “The report is a summary of the Commission’s findings in terms of gathering evidence, listening to witness testimonies, and examining the reports of human rights organizations in order to refer them to the Human Rights Council, despite the presence of many observations on it.”
Naso stresses that it can be said that “the report is generally good and very close to professionalism and is distinguished from other previous reports in that it clearly indicates the responsibility of the Turkish state for many of the crimes that have been described as war crimes, that is, it accused Turkey as an occupying power other than previous reports, especially in paragraphs 67-68-69, by reminding Turkey, as an occupying power, of its legal duties and obligations towards the areas under its control, in terms of maintaining security and securing the safety and lives of citizens, in accordance with the duties of the occupying power contained in the four Geneva Conventions.
He continued: “And also by affirming that it has effective control over the areas under its control in accordance with what was stipulated in Article 42 of the Hague Conventions 1899-1907 to consider the state an occupying state in addition to its accurate listing of many crimes and its confirmation that its information has been collected from multiple sources are identical ”.
Nasso referred to the authorities concerned with human rights and international reports, saying: “There are many terrorist groups in Syria according to the international classification, and certainly the committee’s speech is not directed at these groups, but at the international community through the Human Rights Council, which in turn can do a lot if it has the desire, will and the political green green of the Great Powers !!! Where he can refer the report, accompanied by recommendations, to the Security Council, in order for it to issue a resolution under Chapter Seven or refer the file to the International Criminal Court.
Naso concluded his speech by emphasizing the importance of international and human rights reports, saying: “These reports are not only for archiving, but are of great importance in terms of being adopted as reliable and legal evidence because they are issued by an international human rights body in international courts in the future to condemn Turkey and the mercenaries of the terrorist Syrian National Army and its political incubator the Syrian Coalition.
