Afrinpost – Special

Afrinpost learned from its sources that the militia of the “Military Police” affiliated with the Turkish occupation and the Muslim Brotherhood had released the killer of the Kurdish elderly “Ali Ahmed” from the people of the town of Meydanki, which is affiliated with the “Shara / Sharan” district, only two weeks after his arrest, under the pretext that he is minor at seventeen years of age, and that the families of the martyr have dropped the right of their personal claim.

The sources said that the elders of the criminal “Fahd Al-Marai”, who is a member of the “Sultan Murad Brigade” militia, visited the family of the martyr “Ali Ahmed” and demanded that they drop their personal right, saying, “In all cases, he will be released because he is a child and he has not reached the age of eighteen.” In their effort to pressure them to drop their claim in their personal right.

Concerning, in a special statement to “Afrinpost,” member of the administrative body of the Kurdish Legal Authority, lawyer Hussein Nassou, said that “the crime committed by the settler mercenaries against the Kurdish elderly Ahmed Ali (Aliki), which led to his death as a result of severe beating, the legal description of it is minimal is the harm that leads to death, the punishment of which is temporary hard labor from five to fifteen years, according to the text of Article (543) of the Syrian Penal Code, if not intentional killing.

Continuing: “Consequently, the release of the perpetrator days after the commission of that heinous crime, constitutes a violation and contempt for the law under any pretext or pretext, even though we realize that these mercenary groups and the Turkish occupation government do not give any attention or respect to the laws, even if the perpetrator is as it is alleged that he (a minor) has not completed eighteen years of age.

Adding : “This is because the text of Article 29 / c of the Syrian Juvenile Delinquency Law of 1974 is clear and explicit in this regard, as it stipulates that the felonies of juveniles who have completed fifteen years shall be punished with imprisonment with employment from one to five years, if the crime is the one he committed is considered a felony due for temporary hard labor or temporary detention.

Nassou concluded his speech by saying: “To release him so quickly on the pretext that there is a forfeiture of the personal right in it is another violation of the law, because the forfeiting of the personal right is considered one of the estimated mitigating reasons justified to reduce the penalty in half, and not canceling the sentence altogether, because it is a mitigating excuse and not a substitute excuse for punishment.”

The “Sultan Murad Brigade”, which occupies the town, along with three other militias, without clarifying where they headed to.

The sources confirmed at the time, that the martyr’s house, “Aliki”, was a scene for the implementation of the horrific crime, as the martyr had demanded the settlers to remove their herds from an olive field planted with vegetables and located next to his house, but the perpetrators swarmed a muscle saying to him, “We liberated this land with our blood and we have the right to tend our herds wherever we want, and as Kurds, you should leave these homes. ”The sources pointed out that the attack with sticks and punches affected the elderly“ Amina ”, the wife of the martyr, even though they suffer from bad health conditions.

Despite all the information that was transmitted and still transmitted by Kurdish news observatories to the world and human rights and media organizations about the horror of the violations committed in Afrin, those authorities remain committed to the silence, even in their reports regarding the catastrophic situation in Afrin.
